1. Scope

The general conditions of sale (CGV) apply to all orders which have been made by customers living in Switzerland or in the principality of Liechtenstein on the online shop of the company “Les Bergues coiffure”, 5 rue du Mont -Blanc and 18 rue Kléberg, 1201 Geneva, lesberguescoiffure.ch. “Les Bergues coiffure” only delivers its services on the basis of these general conditions of sale. By placing an order, the customer expressly accepts these General Terms and Conditions. They are an integral part of the contract between the client and “Les Bergues coiffure”.

2. Information on the website/offer/price

2.1 “Les Bergues coiffure” constantly strives to inform and inform customers as best as possible about the products and services offered. 2.5 At the time of ordering, prices are binding for both parties. In the event of errors or incorrect indication of the price, lesberguescoiffure.ch reserves the right to make price changes subsequently. In this case, the customer is informed and is not obliged to purchase the products affected by the price change.

2.6 All prices are in Swiss Francs (CHF) and include, unless otherwise stated, value added tax imposed by law.

2.7 In addition to the prices indicated, the shipping costs expressly mentioned on the page where the article is described according to the type of shipping are also due.

2.8 From an order amount of 200 CHF, after deduction of discounts and special promotions, shipping costs are paid by “Les Bergues coiffure” (except A-mail against signature).

3. Order/delivery

3.1 An order is binding for the customer when, at the end of the order process, he confirms it on the page where the total overview of his order is displayed by clicking on the button "order with payment obligation".

3.2 Immediately after the order, the customer receives from “Les Bergues coiffure” an e-mail confirmation of receipt corresponding to the e-mail address he indicated. Until an order acceptance is sent by separate e-mail to the customer, “Les Bergues coiffure” reserves the right to refuse the order or reduce the ordered quantity, which means that there is no no contract between the customer and “Les Bergues coiffure” or that the contract relates to the reduced quantity. Unless the customer informs “Les Bergues coiffure” by return that he is not interested in the reduced quantity of the order.

3.3 “Les Bergues coiffure” reserves in particular the right to refuse an order if a dispute exists with the customer, especially in relation to payments not made for orders already made with “Les Bergues coiffure”, or if an invoice owed by the same person or by a person living under the same roof is still open.

3.4 The complete and correct indication of the delivery address is the responsibility of the customer. In the event of indication of a wrong address by the customer, delivery may not be possible, “Les Bergues coiffure” may completely refuse to deliver the product without any request for replacement or compensation being made. .

3.5 “Les Bergues coiffure” delivers goods and gift vouchers exclusively in Switzerland.

4. Delivery and delivery time

4.1 The shipping policy provides that “Les Bergues coiffure” brings the products for shipment within 72 hours following receipt of payment or confirmation of payment.

4.2 For items that cannot be delivered from stock, the delivery time may be delayed and depends on the manufacturer. In this case “Les Bergues coiffure” will notify the customer by e-mail as soon as possible to warn them of the delivery time.

4.3 “Les Bergues coiffure” can only be held responsible for delivery delays and their consequences if these are due to an intentional violation of the contract or gross negligence on the part of “Les Bergues coiffure”. 5. Products delivered in error

Items delivered in error or overdelivered must be returned immediately in their original packaging, within 7 days at the latest. Any items not returned within this time frame will be charged. The costs of returning goods sent in error are paid by “Les Bergues coiffure”. Return costs are transferred to the customer in advance.

6. Gift certificates & bonus program

Per order, a maximum of one gift voucher can be redeemed. At the end of the ordering process, you must enter the voucher code in the field provided. The corresponding amount is automatically deducted from the current order. Gift certificates that exceed the amount of the order cannot be refunded.

7. Shipping costs

All parcels are delivered with the “Postpac Economy” service of the Post Office. The prices are thus agreed (packaging included): 

– less than 2kg: CHF 9.-

– 2 to 10 kg: CHF 14.-

– over CHF 200: free delivery

8. Exclusion of warranty and liability

8.1 “Les Bergues coiffure” guarantees that the products are intact at the time of shipment. Products damaged during shipping are repaired or replaced at the discretion of “Les Bergues coiffure” to the extent that the customer informs “Les Bergues coiffure” of the damage electronically within 7 days after receipt of the goods. If “Les Bergues coiffure” so wishes, the customer must also return the products in their original packaging as soon as possible to the attention of “Les Bergues coiffure”, the related shipping costs being the responsibility of “Les Bergues coiffure”. Furthermore, damage which is attributable to the buyer himself, e.g. following improper use of the product, or for damage caused by external influences which are not attributable to the seller, such as e.g. damage occurring during transportation.

9. Right of withdrawal and return conditions

9.1 The customer has the right to return the goods within 14 days of delivery. He can assert this right by returning the goods. No justification is necessary. Returned products should be sent to the following address:

9.2. Returned products or packages will only be accepted if they are in good condition, ie new, unopened, undamaged and in their original packaging.

9.4 After receipt of the goods, the amount of purchases already paid will be immediately refunded to the customer. Shipping charges will not be refunded. 

9.5 “Les Bergues coiffure” guarantees that the products are not damaged at the time of shipment. 9.6. If a gift (GWP = gift with purchase = gift with purchase) is attached to an order above a certain purchase value, restrictions apply to the return of goods. If the entire order is returned or if the new purchase value is lower than the condition for the GWP, the gift must be returned as well. If not returned under these circumstances, the value of the gift will be charged.

10. Payment methods and invoicing/payment reminders

10.1 Orders placed via the lesberguescoiffure.ch website must in principle be paid in advance using the payment methods indicated on the lesberguescoiffure.ch website. The following payment methods are available to you: Visa, Mastercard, American Express, Discovery, Paypal, Gpay, Apple Pay. If delivery against invoice is indicated as an option when ordering, the payment period per shipment is 30 days.

10.2 If the payment deadline is missed, “Les Bergues coiffure” is entitled to charge late fees of up to CHF 30.00 in order to partially cover the costs incurred. The amount due on the invoice, to which are added any late fees and default interest, may be transferred or sold to third parties for collection purposes.

10.3 In the event of advance payment, you will receive the bank details of the company “Les Bergues coiffure” in the electronic confirmation message after the order.

10.4 We reserve the right to carry out a credit check, whether for new customers or for existing customers.

10.5 Until full payment for the products ordered or until confirmation of payment by the company issuing the bank card, the products delivered remain in all cases the property of “Les Bergues coiffure”.

11. Data Protection

11.2 The data necessary for the transaction are stored, processed for the required purposes and, if necessary, passed on to the companies or contractors concerned, e.g. Swiss Post or other companies carrying out credit checks within the framework of order processing. All personal data is treated confidentially.

11.3 In the "My account" section, the customer can modify his personal data at any time.

11.4 “Les Bergues coiffure” uses and processes personal data for the management of its customer relations, as well as for internal marketing purposes. The customer has the possibility at any time to prohibit this automatic evaluation. If no automatic personalized assessment is desired, the customer can refuse it in writing whenever he wishes.

11.5 The customer only receives a newsletter from “Les Bergues coiffure” upon express request. It is possible to unsubscribe at any time.

12. Liability

12.1 Liability for defects in the product or damage caused by such defects is exclusively as described in point 8. For damage due to late delivery, only point 4 applies.

14. Applicable law/jurisdiction

The contract is exclusively subject to Swiss law. The place of jurisdiction for all disputes with “Les Bergues coiffure” – subject to different courts of jurisdiction imposed by federal law – is in Geneva, Switzerland.

15. Changes to the T&Cs

“Les Bergues coiffure” expressly reserves the right to modify these general conditions of sale depending on the circumstances, then to apply them immediately to consecutive orders.
